I am a teacher and am very upset by what has happened to a young man that I got to know. This young man came to the U.S. as a 16 year old to practice his sport with a coach who is very good. He only had a toursit visa. Because he was going to be in the U.S. for several months, the coach enrolled him in school (public) and told this young man's family that he was taking care of the cost of the school out of the money his family was paying the coach. When the student went home to Mexico at Christmas and then tried to return in January, he was denied re-entry. Immigration told him he was breaking the law by going to school on a tourist visa and sent him home. He was devastated. Since then, he has applied to get another visa - just a tourist visa so that he can come here and play in tournaments. His dream was a U.S. scholarship, and the embassy denied him and told him that he cannot apply for another visa for 10 years. My question is shouldn't he have been granted leniency because he was just a kid. His coach and maybe his parents should have been held responsible, but not him. He was a minor and had no idea what he was doing was illegal. Now all of his dreams are crushed. Even if he goes to college outside the U.S., he will not be able to go to a college that competes in the U.S., because he is not allowed in. It just seems unfair. If he paid the school district back, shouldn't he be given another chance? He is just a kid. He is 17 now and understands the law very well. Would it be worth it to hire a lawyer or would that just be throwing money away?

sounds like fraud to me--sue him and report him to immigration |

He can argue that he was not at fault and the coach committed fraud; and ask for an exception. Best to have counsel involved however.
