Confused return for the dearly deported?

My close friend was deported from the U.S. in September of last year (2008) because he had a Student Visa and his mother stopped paying his tuition, though she knew he would not be able to work to pay it himself.

He also carried a Tourist Visa which does not expire until 2016, which has not been violated, and obviously is not yet expired.

I.C.E. confiscated his passport and held him in a maximum security prison in Arizona for 5 months before deporting him saying that he cannot return for 10 years.

My reason for posting is that I would really like my friend to be able to come visit again and he did nothing wrong in the first place to violate his visa(s). Is it possible for him to return to the U.S. using his still valid tourist visa (provided I can get I.C.E. to return his passport)?
