Default deportion question

seeking help...

a friend of mine was jailed for 40 last month...he finised his time a few days ago but soon after the imigration took him in order to send him back to his country...

when he was punished by the judge he was given a 3 years of probation along with his 40 days of jail...he was stinged by the imigration and charged with attempt to rape/engage in sexual activity with a minor...

my question is can he be deproted with the punishment he recieved and dont he have to serve his 3 years of probation before the imigration to do anything to him?

They can do it either way deport now or make him serve time and then deport.

Increasingly they make the person serve time and then deport them.
