Default Mean Debt Collectors, I can't sleep! PLEASE HELP ME!

Some debt collectors called me a couple days ago from a law office number. When I was 18 I got a credit card and never made a payment, I think I opened the card 11/2004. These debt collectors told me that the bank decided to get a lawyer and they were going to sue me. I set up a payment plan through my parents account. I then decided that was a bad idea and stopped payment. I was scared into it!
I called the bank the card was through the next morning and I was informed that my account had been sent to a collection agency and that the bank was not taking any legal action against me. The bank also informed me that the amount that the collection agency told me I owed was more than my actual debt.
I am a single mother in school full time. I live between my house in KS and my parents in CO. I have nothing in my name, not even a car, and I have NO money. I don't know what to do! I can't stop worrying!

By the way Sam Streeter is the name that comes up on the caller ID when these people call me!

Once you have entered both, you will find there are many things that that a bill collector simply cannot legally do, and it appears that you MIGHT HAVE GROUNDS FOR BRINGING A LAWSUIT AGAINST THIS GUY SAM STREETER !

I've read that he is a SCAM....actionable offenses in accordance with established law, and matters which can be dealt with by filing complaints with your area district attorney as well as thrU the FEDERAL TRADE COMMISSION

First thing I would do is record any future conversation (make him aware of this) Tell him you need a letter from him. This way you will know how to reply (PER MY INSTRUCTIONS)

Please reply to this post with details on exactly what he has said, and by all means get the name of his law firm and mailing address.

SIMPLY PUT...a bill collector cannot ask for, co-erce or extort your personal information (such as your bank account info or credit card info.) tell your bank that no future charges debits to your account are allowed by him or his firm. Better yet, close that one bank account and open another, or he may still try to access your funds.

It is illegal to threaten you with imprisonment, to coerce you into giving bank information and to harass you. I am reading Debt Cures by Kevin Trudeau and he explains everything. I really recommend this book to anyone who wants to be free of debt. You have rights and also they can not get what you don't have. If this is a collection agency that means that your original debt was claimed as uncollectible and the company was compensated for that debt. They sold this debt to a collection company for pennies on the dollar. The collection company is now trying to strong hold you into paying them for a debt that you don't owe them. Remember that debt was already settled with the original creditor (they were compensated for it).

If you write them a letter stating that you own nothing-That you are leasing a car and renting an apartment and have no assets that might be enough to stop them from coming after you.

NEVER agree to a debt. Make them prove it. Since you didn't know and you already agreed to it you should probably seek legal help. Google free legal advice for you area and a list of non profit lawyers should pop up.

Here's how to handle these unscrupulous debt collectors:

Send them a certified letter, return receipt (so they will have to sign for it)

Address the letter to the CEO, GENERAL MANAGER AND STAFF.

IN THE BODY OF YOUR LETTER, advise them that you dispute this ALLEGED DEBT, AND THAT THEY ARE TO IMMEDIATELY CEASE AND DESIST from further communication with you under penalty of law, until such time as they have COMPLETELY AND ACCURATELY VALIDATED THIS DEBT IN IT'S ENTIRETY, and under PENALTY OF PERJURY in accordance with the:

FAIR DEBT COLLECTION PRACTICES ACT

US CODE TITLE 15

TRUTH IN LENDING ACT

FAIR CREDIT REPORTING ACT

Also advise them that if they continue to HARASS you that you intend to MOVE FORWARD with complaints to the

DISTRICT ATTORNEY'S OFFICE IN YOUR STATE well as the STATE IN WHICH THEY ARE LOCATED

STATE DEPARTMENT OF CONSUMER AFFAIRS your state and theirs

BETTER BUSINESS BUREAU in both states..yours and theirs

Also, advise them, that you intend to file complaints with the BAR ASSOCIATION in your STATE AS WELL AS THEIRS under " THE ATTORNEY ACCOUNTABILITY ACT OF 1995"

Also that you intend to inquire with the FEDERAL TRADE COMMISSION in both states as well as Washington , DC ABOUT THE POSSIBILITY OF FILING FOR A
CLASS ACTION LAWSUIT AGAINST THEM, holding their COMPANY, OFFICERS AND STAFF personally and corporately liable.

FURTHER ADVISE THEM THAT YOU INTEND TO CONTACT your CONGRESSMAN IN WASHINGTON , DC and ask them to assist you by expediting your complaint with the US DEPARTMENT OF JUSTICE as well THE FEDERAL TRADE COMMISSION in WASHINGTON.

Also, in as much as you question their legitimacy, and since the letters you have received from them appear to be deceptive and misrepresent the facts, and in as much as the letters have been sent by US MAIL AND CROSSED STATE LINES in TRANSIT, that you will file complaints with the US POSTAL SERVICE complaints and FRAUD DEPARTMENT,and that you will inquire also with FEDERAL BUREAU OF INVESTIGATION requesting they investigate this matter as well, in alleged violation INTERSTATE and INTRASTATE COMMERCE LAWS.

Close your letter by stating:

EITHER 'CEASE AND DESIST" FROM FURTHER COMMUNICATION AND COLLECTION ACTIVITY" or you will move forward with the above.

I remain respectfully yours,

(your name and address)

NOTE: GOOGLE " FAIR DEBT COLLECTION PRACTICES ACT" AND ALSO USCODE TITLE 15, and you will probably find that the COLLECTOR has violated ONE OR MORE OF THE ARTICLES IN EACH. BE SURE TO ADDRESS EACH OF THE VIOLATIONS YOU FIND in your letter.

ALSO GOOGLE "ATTORNEY ACCOUNTABILITY ACT OF 1995" FOR INFORMATION PURPOSES.


Use this letter and exisitng law to SLAM THESE COLLECTORS . make them aware that you know your rights !!
