Angry Billing after insurance cancelled.

My husband visited a chiropractor in March 2007. We had 100 % coverage. The Dr.'s office said not to worry about it, they would direct bill our insurance co. for us. In July 2007, my employer changed insurance companies without notice. In October 2007, I receive a bill from the chiropractor stating, they were past the billing deadline and I had to pay for the bill. I said that I didn't feel this was my resposibility since they had the opportunity to be paid in full by insurance but didn't bill them till eight months later. I told them that I would talk with the insurance company and see if I could get them to wave the deadline. In the meantime, I receive a letter from the chiropractors lawyer ( same last name) stating that another bill was outstanding from July 2006 and if I didn't pay these they would take me to court to collect and charge me court fees as well. Both of these invoices would have been covered 100% if they had be billed in a reasonable period of time. Am I still responsible for these or am I being bullied by family members in the legal field?

Default Re: Billing after insurance cancelled.

If they knew of the deadlines, then they are at fault. You would normally prevail in small claims court.

You relied on them to bill as they said they would. They failed to do so.
