Default Statute of Limitations (SOL)

In CA the Statute of Limitations for a debt is 4 years (there have never been a payment made). What happens if this time has expired but befoe it expired (9 months before), a collection agency filed a civil matter in Court? Does the SOL stop at the time of filing or if the 4 years (at this time 4 years 3 months have passed) expired, is the SOL applicable?

Per the question at hand, this has yet to go to Court or have a hearing date scheduled, although there may be one set within the month.

If they file and served you then it is valid. They can sue.

Randalljd,
Thank you for your time and expertise. Is there a winnable defense in this matter? Combined with all the other bills, another scheduled payment will most likely ruin me financially.
