My Mortgage was brought by a trust company as trustee under pooling and
servicing agreement as of Feb 1, 2007 securitized asset backed receivables LLC trust mortgage pass-trough certificates. New Century was the original mortgage holder, which they went out of business, an was the first lender to fall in the sub-prime markets. This process was happening all at the same time. I\'m behind on my mortgage by ten month do to a medical condition my is enduring wife. The trust company has no records of the original mortgage and promissory note, and the said documents are no longer within the custody or control of the plaintiff ( The Trust Company), and is now requesting that the courts enter an order of reestablishing the said lost documents. How Can I avoid this trust company from foreclosing on my property? |

First, I don't know if your house has been taken already. If not, you need a good attorney. If the lender does not have the documents you can object to the reestablishment of the documents. Many judges have refused to allow this.
