My husband & I separated 5 years ago this month. He had the big income and I had just started to work so he took the credit cards that had the most owed on them and said he would pay them, even some under my name. I kept some that were in my name and some that were in his. He moved to Ca. and after several months of me sending the bills to him he had the address changed on the ones he was paying. After a few more months I found out that he stopped paying on most of the bills. I had all I could do to pay what I kept and there was no way I could pay anything at all on the ones he had agreed to pay. I was only making $7 a hour, but I continued to pay on the ones I kept. Even after I lost my job and was out of work for almost 5 months I continued paying my bills, I even sold my blood 2 times a week because I couldn't find work. But I was never late on any payments. I still pay on every bill I kept. When I first started to get calls about the bills not being paid I told the creditors that he had agreed to pay them and they had changed the address to him. I gave them the last number and address I had for him, but he changed it. Now I get calls and letters all the time about unpaid bills. I never answer my phone any more. I live in Texas and just saw on one of the news program about a company sending out lists with names from unpaid debts to banks and banks freezing the accounts of those people. Is there anything I can do to prevent this from happening to me. I thank you for any advise you can offer.

If you file for divorce the court will assign those debts between theh two of you or to him if they are his, and then if payment is not made he will be in contempt.

I'm not an attorney, so this is just my opinion. A creditor has to obtain a judgement before they can try to freeze a bank account. In Texas, you have a lot of exemptions (probably the best debtor friendly state to live in) so that is a good thing.
If you know that the creditors are suing you and getting a judgement, TAKE YOUR MONEY OUT OF THE BANK. Good luck to you. |

Thanks for the advise so far. As for divorce, I don't have the money. Every penny I make goes for bills and putting a few dollars away for the IRS. I work from home and don't have anything taken out for taxes, so I have to pay each year. Which also seems to mean that I don't earn wages, which in Texas can not be garnished.
For the next reply, do you know if and how I would be notified if a creditor was suing me? Thanks for the advise. |

They would have to personally serve you court documents or at least send registered mail to a known and valid address of yours.
