Default bank took money from my account

i had a car loan through bb@t... and during that time things changed at
my
job... a company came in and bought my employer out.. which changed my
salary dramically... i struggled for a few months trying to keep-up my
car
payments... even trying to make parcial-payments.. but, that was not
agreeable with bb@t... they said full payments or they would haft to
reposess... so, i voluntary turned the car back into them.... so, 2
months
without any notice, they withdrew 1916.44 out of my checking account...
(every dime i had) stating that, it was the difference on sale of the
car.... which, i understand but yet, they didn\'t tell me in advance so i
could prepare for this... i asked them why was\'nt i informed... and
they
said that, they didn\'t haft to inform me.... and even went on to say,
they
believe if they had of told me that, i would have pulled the money... is
this legial.. they say, because i have a bb@t account that they have the
right to take it without my permission....

, they said, the banks loan department pulled
the money..... and they have that right... that when i opened a checking
account with them , it was in the fine print.... but, still i feel i should
have been told before.... does'nt seem legal without some notice... they
never even sent me a paper as to what i owed....

No--tell your bank you did not authorize the withdrawal and the bank must
credit you back--some banks don't see to know they must credit it back. So you may have to push them a little.

If the agreement is with the same bank they can do it sometimes yes---but
you could still threaten to sue in small claims and they may
compromise...you can argue it was never really made clear to you.
