Default Still on Ex's Delinquent Car Loan

My name is still on the loan for my ex's car loan. They would not remove my name unless he refinanced the car - which he couldn't do because he didn't qualify on his own.

It's an upside down loan - owes much more than the car is worth.

My ex filed bankruptcy last year but did not include the car.

The monthly payment is $765. The car needs a new transmission for $2,000 which he can't afford.

He is turning the car in to the car loan company voluntarily and said the bankruptcy will protect him but he doesn't know what it will do to me.

Can the car loan company come after me? Is there anything I can do to protect myself? I have since moved out of state and remarried.

They can come after you.

That is exactly the danger of co-signing.

And if he listed you in the bankruptcy then often you cannot even sue him.

You may have to sell the car and take the loss.

He must have listed me in the bankruptcy because I keep getting notices of hearings in texas.

He has traded the car in and gotten another one. Can I go after him for any of that?

Yes you may sue him unless he discharged the debts in bankruptcy--(I am assuming you two were not married.)
