How do I collect money owed from deadbeat room mate?
I had a a friend that I let move in with me (Sept 2010) with the understanding of her paying monthly rent utilities etc. She stopped paying much of anything 3 months after moving in. Being that she was a friend I let her stay in hopes that she would get a job and start paying again. That didn't happen. She kept promising that once the Will of her recently deceased father was settled that she'd pay me back what she owed. That hasn't happened yet either. I lost my job in Feb 2011 and am still unable to find a job which has now resulted in my inevitable loss of my apartment since my room mate left me high & dry. To date, she owes me $5600.00 for back rent/utilities etc. Before I kicked her out, she signed a contract that I had written out detailing the money she owes me, I also have her on audio recording (that she is aware of the fact that I recorded it) saying that she would be paying me back in 2weeks since the Will would be settled then. We are now halfway into week 2 and she has yet to respond to phone calls/emails from me. I am being forced to leave my home and move out of state to stay with friends. I need to make her pay me what she owes me ASAP. HELP????

I wish to inform you that you can send a demand notice. If the other party does not pay the amount then you can file a law suit for recovery of amount not paid. You are creditor of your friend for the amount not paid. Audio recording along with contract will show your demand for unpaid rent. You may self represent yourself or may have a lawyer to represent you.

At best, since you are leaving the state, you will have to pay someone to collect for you -- either a lawyer or debt collection agency. If you are not able to get her address from common acquaintances, skip tracers can be hired to do the job. Then she will have to be served with suit for the money.

If you don’t have her contact information, it seems that the next best step you can take is to file a complaint with police department briefing these facts. If you have any photograph of her then hand over the same to them. They will investigate and will let you know if they find her
