I just received a notice today from a debt collector for a check that bounced (I'm assuming it happened about 3 years ago or longer). They didn't tell me the amount of the check, the check number or even when it was written, only who it was wrote to. Not only that they want me to pay and I am an unemployed stay at home mom. I wasn't with my husband at the time of writing the check I know of for sure. Can they hold him accountable for payment? I don't work how can I pay? Is the statue of limitations in the state of Indiana six years for collection of payment? Plus the collection agency is from New York, I am a resident of Indiana. Does that make a difference?

Your spouse is not responsible. Bounced checks often do not expire. Best to pay if possible--at least the amount of the check.

I would look into who's trying to collect, some debt collection agencies try to open old claims and collect. Call the company who the check was for, see if they did turn it over to a collection agency. Since you're a stay at home mother, check to see what income you have is protected from judgments. The collector could threaten to ruin your credit, but at the same time if might not be worth it to them to get a judgment, depends on the amount of the check.
Since this has happened, see about getting a homestead declaration if you have a house. This protects your home from any liens. |

who was the check written by you or your husband? If it was you pay it. I want to know how you support yourself and your household if your a stay at home mom? Do you make your ex pay all the bills and child support and alimony or do you collect state moneys and food stamps? How about you go get a job???
