if I am taking someone to samll cliams because he scheme me out of money..Can this person now file bankruptcy and not pay me

...and in the US as well
but if you can argue actual fraud the bankruptcy court will not discharge obligations due to fraudulent behavior and that is true in most jurisdictions... |

It's unlikely he will have his bankruptcy case settled before you actually take him to small claims court. He cannot use bankruptcy at this time to get out of paying the judgment, should the court rule in your favor.
