Default Documents A 3rd Party Debt Should Have

If a 3rd party debt collection is going to win suing you in court, what kind of documents should he have. This is credit card debt.

They will need to provide proof they own the debt. I.e., documents showing all previous payments and dates they were made, from the original creditor. They also need to provide the document showing the original creditor sold/assigned the debt to them.

Show up for the hearing. You will lose by default if you don't. It is very difficult for 3rd party collection agencies to win when they file suit. They have a very weak case to show they own the debt. Consult with an Consumer Protection Attorney in your area. Many work on a contingency basis and will not charge you for a consultation. It is in your best interest to speak to an attorney.
