Answered The Summons Today

Went to court today to answer the summons, also got a court date. Went so the plantiff would not win on a default judgment. I made sure to put in writing what I want them to show me as proof the debt belongs to me. Also made sure to let them know my only income is SSI which makes me collect or judgment proof. I have no extra money . I live month to month on a small income. We will see what happens, if they win,if they show up at the actual trial date, at least the summons was answered, but it will be hard for them to collect when the other party don't have anything.

Their attorney will likely show up for the court date. They are notorious for fighting even the most frivolous battles where they know they are in the wrong and have violated the Fair Debt Collection Practices Act as well as the Fair Credit Reporting Act.

Remember to show up and remember to consult a Consumer Protection attorney. Many work on a contingency basis.

If they do win, you're right, it's difficult to actually collect. Unfortunately, they may place a lien on any property you may own. Your credit will also take a hit as the judgment will be placed on your credit report.

Sometimes they don't show but make sure that you do so!
