Hi,
A fraudulent account opened in my name in 2001 and i recently ( april 14 ) received official notice that it in fact was fraudulent from the bank in question (after beginning the investigation January 14 and being told it was fraud in February) and that it was being removed from my credit history. That letter ( april 14 ) did not reach me however ANOTHER letter dated in early May (2nd or 3rd i think ) did reach me. So the bank has 2 letters to me on file and numerous phone calls logged, even the collection agency (both the initial bank owned collections and then a private firm) has me logging a call to get them to turn over the account to the bank so it can be closed as fraud (early April). As of June 17, the account is still listed on Experian despite my letter, phone verification from a fraud representative at the bank that it was removed ( 2 times - april 15 and June 2 ), collection agency removed their credit report spot and a consumer credit investigation by Experian dated June 17. If i'm understanding correctly, this is well past federal limitations under FCRA and my state law (tennessee) states legal action can be taken against whoever is failing at their job, either Experian or the bank. My question is, what action can I take against this and who is at fault? By my view, it seems like the bank is the one failing at backing up their word. Also, what kind of lawyer do I need to talk to if I do have legal recourse available? In any case, this is preposterous how much i've had to deal with and it's directly impacted my life harshly. I never use credit, period, so I never knew it was on there. Only recently did I actually take notice and deal with it but it kept me from renting or getting a credit card as most places don't look kindly on a charged off card with a collection agency after me. |

You can file naming both and let them sort it out in any case.
Frankly just the threat of filing may cause them to resolve this. |
