When disputing an account via e-mail with Experian an email was returned to me in a matter of minutes saying that the account was verified. At this point what can I do to get this removed from my record.

The major credit reporting agencies use a system called E-OSCAR to "verify" information with the creditor who placed the item on your credit report. It takes very little information to have the item "verified". It's incredibly inept, but unfortunately, that's how it works. You can google E-Oscar to get an idea what kind of form is used.
Send a validation letter to the creditor who is reporting it; asking for validation of the debt. They must respond within thirty days or it must be removed. Send the letter certified, return receipt requested, and put the certification number on the letter you send and keep a copy for your records. Do NOT sign the letter. Wait to hear back. If they validate it, do nothing. Don't enter into a verbal or written contract to pay. If you do, that will restart the clock and the item will remain on your report for 7 more years. If they cannot validate it, report that to the credit reporting agencies who have it listed. If the creditor cannot verify it and continue to report it, contact a reputable consumer protection attorney and sue them. |
