I have a friend who had her car repo'd this morning. The lender "claimed" they had called daily to her cell and work for the month of Dec. which is out and out false. I told her to demand their phone transcripts showing that activity. She had gotten a verbal deferment of the Dec payment and just received a bill in the mail showing her to be current and only January amount due. I am STUNNED that in this environment a company would even do such a thing, but what legal recourse does she have? She is willing and able to continue her monthly payments, but now they are socking her with 2 months payments + repo fees + repo storage daily until matter is resolved. They also want to charge her $35 to take her belongings out of the car, but I have read that Texas law allows her to get her belongings. Obviously she can not prove an oral deferment, but her printed statement showing current status (save for Jan bill it noted) should protect her from being repo'd wouldn't it?? ANY legal advice is greatly appreciated!

If she was behind at all they unfortunately can take the car.
