Default Is a default on a payday loan considered "check fraud"?

Is a default on a payday loan considered "check fraud"? I know they consider them what they call a COD order or certified funds since they are taking it right out of your bank account. But I am worried about getting arrested for check fraud. I have offered to pay this debt at what I can afford as I am out of a job for the last 2 months. They will only accept the payments if I post date which I refuse to do because they can and will post them earlier than specified date. The debt is like $900 (that is including all the tacked on service charges). He says he can settle it for $600.00 but I cannot afford this lump sum amount as I an unemployed since this all took place. He will turn this over to go to as he says "county authoroties in a few days. Any advice would be awesome.

Have u heard anything regarding this matter. I know this was back in 2008 but has anything been resolved. I was threatend with a matter of the same kind. Only the legal dept says i should seek legal advice if not paid by a certain time, and will be served an hour later. Can they really do something?

This means is that the Fast Payday Loans industry has the market concentration to collude, but without explicitly communicating with each other they cannot find a stable equilibrium price point to settle on for Fast Payday Loans.

In order to suggest you something about your current problem..I would suggest you to take out a personal loan to payoff your payday loans..

You can't get arrested for defaulting on a payday loan. If you get a call from an "attorneys" office saying you will get arrested, its a spam. Call the federal trade commission and report this suspicious activity. This happened to me to. I went to a local payday loan place to discover this and what to do.

There is a payday loan scam listed on multiple websites, and also the FBI scams and Frauds.

Threats such as "Arrest". Contacting local authorities, Threat to other family members, coworkers, Threats that the DA is being contacted, and more.

If you get a call from one of these agencies, ask them for the name of their collection agency, and address, and tell them that you will need to take the issue to your attorney first.

My self, and my children have had to deal with one of these companies. They have told MY CHILDREN that I have committed check fraud, and that I may be arrested. They are sinking to big lows.

Also check the number online. When I first became suspicious I checked the number. (It was my local area code). The number was listed out of Moscow!

I know this is scary, but throw it back at them. Even if you owe a payday loan. Deal only with the loan company themselves. Inform these bullies that you are turning their information into the FBI. See what they tell you then.
