brother has received a court summons to appear in court over a debt
My brother has received a court summons to appear in court over a $9,000 debt made on a credit card that he stated had been stolen years ago, to which he filed identity theft. The court summons states he had to appear in court 20 days from the receipt of this letter. He wrote to the courts stating that this was not his debt because that card had been stolen, they advised him to hire a lawyer and disbute the charges. He can't afford a lawyer, but he doesn't want to pay for something he doesn't owe.
What should he do? He is truly stressed out because he believes they will take his home in order to satisfy a debt that doesn't belong to him. Can you tell me what his next recourse should be? Worried Sick Diane |

Surely he has documents to prove that the card was indeed stolen (i.e. police records). Has he tried presenting these to the magistrates?
