NY state divorce law / debt inquiry. Need help please.
Hi,
I've recently found out from my wife that she accumulated a significant amount of debt on her credit cards and debt from the stock market. Below is a more detailed explanation of my situation.
My wife has accumulated approximately $50,000.00 debt from credit cards. Additionally, I've been informed by her that she has accrued a substantial amount of debt, approximately $125,000.00 due to the unstable stock market.
The credit card debt accrued is under her name, although I was aware of the situation (i.e., our family needed additional money in the last few years for living necessities).
The stock debt accrued is also under her name in which I was unaware of.
Therefore, the reason for this divorce is because my wife has accrued a significant amount of stock debt without my knowledge or approval. In addition, this marriage was established in NY and we have not signed a prenuptial agreement.
My question pertains to:
1. The credit card debt my wife has accrued, will I be responsible for her debt once we divorce?
2. If she declares bankruptcy after our divorce, will I be liable for the credit stock market debt she has accrued?
3. Will banks/creditors/collection agencies look for me once we are divorced and she declares bankruptcy?
