Confused Falsifying Statements

I was just wondering if anyone has any knowledge of my rights as it pertains to a Loss Prevention officer at my former place of employment falsifying a statement made by my fiance to get a statement out of me stating what they wanted based on the facts that they knew one of us would take blame? In short I was given substantial discounts at a department store and was told by Loss Prevention that my fiance admitted to putting "unrung" items in the bottom of the bags which is untrue. I took the blame for it because I was told that she had already admitted to doing so (which is not the case because she only admitted to discounting items that I PAID for) and now we have both been booked for Theft in the 3rd degree. Does anyone have any advice asto our rights? Thanks.

That is why you should always have a lawyer involved when that kind of questioning begins...unfortunately that is not illegal behavior but can still possibly be challenged in a few different ways.

What if when the questioning occurred we were never presented with the option of attorney? They literally pulled my fiance and myself off the floor one after the other, her first and then myself. Questioned both of us without the option of attorney, and then had us arrested and booked all without option of attorney. Now we have received our subpoena for our arraignment and don't know what my options are. I also wrote up a formal retraction of my initial statement based on the evidence I had gained after the questioning. I cannot afford private counsel so I will have to use a public defender. Any suggestions on this info? Thanks.

Store security can question you as they wish but you don't have to answer or cooperate of course.

They don't operate with the same police rules and requirements.

Well I guess my only question now is what chance do we have of getting the charges dropped and not facing a penalty? Based on what has been presented of course, and perhaps a next step? Thanks so much for the help.

It would be advisable to have counsel intervene if you want to fight it.

It is not a good idea to try to do that alone.
