I am on probation for a felony drug charge and have recently violated multiple times. I have heard that when you violate your probation, you go to jail for the full term of your original recommendation. The crimes are punishable for 0-4 years in jail, and i was charged with 2 counts. My guidelines from the psi (pre sentence investigation) were 0-6 months in jail. I was sentenced to 6 months suspended upon completion of oakland county boot camp followed by 2 years of probation. i quit the boot camp, so i spent a 6 month sentence in jail. is it true that when i violate, the sentence can not be higher than my original guidelines of 6 months in jail, which i have already served? my probation officer informed me i have new higher guidelines of 0-17 months and i will probably be returning to jail, but my friends say this is illegal and i cannot spend more than my original recommendation. also, if my guidelines were 0-6 months, and i did 6 months in jail, shouldn't i be without probation, since i did the maximum sentence?

The judge has discretion to set the time, but normally it will not exceed the originally recommended sentence if that is what you are asking
