Someone I know that has a small child from a pervious relationship, is
about to marry a man from Ohio that is a registered sex offender, he is a tier 2 level sex offender. He commited the crime in indiana where he was convicted of having intercourse with a child under the age of 14 yrs old and then he moved to ohio right after getting out of prision and has been registered in ohio for the past few years. my question is, Is it legal for him and her to get married when she has a little girl in the home that is not his? |

Judging from what I have seen and heard I would so no. Especially if he is out on parole. I know a young man here in Texas that had to register for consensual sex. She was 16 and he was 19. He is 24 now and was dating a young women around his age who also had a two year old. All it took was someone telling his PO (probation officer) that they saw a young lady with a toddler in his yard. He had a warrant issued for his arrest. He was very lucky that he didn't go to prison for a probation violation.
Anway it really depends on the terms of a sex offenders probation or parole. Ohio is one state that is extremely strict on these issues, but if there aren't these type of restrictions it may be due to the age he was at the time of the incident. There have been many young men sent to prison for consensual sex...doesn't matter if the girl says it was consensual. Many states have passed laws such as the Romeo and Juliet Act. The girl is over thirteen, and the young man is 18 or under. Texas has this law now and has helped many get off the registery...the girl has to sign saying it was consensual...say you have a 16 year old girl and a 19 year old guy? The 19 year old is scewed. Now.... I am NOT saying this is your sister's boyfriends case....grant it there are violent criminals out there. Has your sister thoroughly checked to make sure her boyfriend wasn't thrown in prison for rape and holding his vicitm at gun point? This is what I hate about the registries. You can have men/young men classified as a tier 2 for urinating in public and because a child under a certain age saw him..Bam...I have even heard some these cases have now marked them as tier 3. As with all relationships...don't rush into something you will regret. Take your time, and don't let love blind you. Surely there should be something your sister go back to...like old news paper articles, doing a search on his name.....sex offense cases are always published...maybe she or you could learn something from these old articles. I highly understand your concern for your sister and her two year old. There are many things you can do to help her...like finding out more about this guy....But remember his conviction states sexual assault this doesn't mean he actually assaulted the victim. The statutory rape law in Texas now reads, assault of a minor...this is one reason why registries are deceiving...because they are making many young men look like monsters over consensual sex.
