disability fraud

My sister is separated from her husband. She received 3 disability checks in his name and either signed his name or just deposited the check into her account. They have been separated for 4 years and he has not paid any child support what so ever. She is almost destitute and needed the money badly. Her spouse found out about it and pressed charges.Her bank account has been frozen which doesn't matter because she had very little in it. Will she have to pay the money back or serve time in prison ? So far there has not been a warrant out for her arrest that she knows of. He however drew up a fraudulent divorce paper saying that he had been paying child support and she makes much more money than she does.She scratched out the parts that weren't true and he blew up and caused a seen. She doesn't have a copy of the document. This all happened yesterday. Any advise would be appreciated. Thanks. By the way her 17 yr old daughter was present and is bipolar. She got very angry and vandalized my sisters husbands new girlfriends car. He pressed charges for that. She already has a criminal past and was just released from probation the day it happened but hadn't been processed yet. I feel that the jails are too full and wouldn't put her in for vandalism. Is this true?

Well they could charge her for that--it is a crime.
