back injury-sue coporation

First I have to tell a little about what is happening. I had injured my
back
years ago, had surgery. Finally went back to work. I worked for a temp
agency. First at Con Agra (a factory) then Dana (another factory). When
they
were finished with us, I had gotten a job with Plastech (factory). Well
to
make it short. I had injured my back again. Had surgery. And the
lawyers I
have could not win any WC cases. So they decided to take it to court.
(Which
by now they are saying That I didnt even get hurt there.) That it was
from
the previous injury. So the lawyers are trying to win in court the
workmans
comp. But when they do I have (if we win) to pay back them,insurance &
anything else out of my portion of settlement. What I want to know is
can
this be dropped & sue the corporation?

Talk to your lawyers about the details, and they should discuss that in depth with you--but sometimes you have to use the WC remedy if you were an employee.
