Solicitation Arrest
My brother was arrested for solicitation of an undercover officer. He got off of work around 1:00 AM. He left work and proceeded to the first available gas station on his way home. While at the gas station he was approached by a women who began to proposition him for sex. He said that she started talking prices and he told her that he didn't have any money and would come back (just to get her to leave him alone). She became aggressive tried to get him to stay, not to leave and told him that she didn't think he would return. He began to pull off and was surrounded by three police officers and arrested. He was taken to the local police station and not allowed a phone call. He was held over night and released in the morning. Upon his release he was told that he would have to appear in court and attend classes.
He feels he was not only falsely arrested but held over night without a right to a phone call. What should he do? |

I am no lawyer by far but that sounds like entrapment to me. The women was an under cover cop? She is not supposed to approach him. She is supposed to wait on someone to approach her. He is definitily allowed a phone call after book in! I would contact a local lawyer.
