Default Filed false statement and warrant taken for battery

I got angry with my husband the other night and had a bruise (something I had done to myself the day before), but after I got mad at him I showed it off and started telling my family and his that he'd hit me and threatened me. I went and filed for a TPO because I wanted to make sure I was given custody of my daughter and to get even with him. Well they told me that I should have a picture of the bruise taken and that I should make a statement so that I'd have a future paper trail if I needed it, but said that I did not have to press charges. Well since I lied about it all I didn't actually want charges pressed I just wanted my case for the TPO. Well the officers ended up pulling out a warrant on my behalf because of my statement and bruise. I tried to tell them that I wanted to recant my statement and tried talking to the officer who issued the charges and to the solicitor's office and neither have done anything to drop the charges. They say he has to be brought in and then let out on bond and that I can drop the charges myself after that, but the state could pick it up if they wanted. He is on First Offender's Felony Probation and cannot get in any kind of trouble. I know that I can be charged with a misdemeanor for falsifying a statement, but it's not right for him to get in trouble because I acted with a hot head and lied. I don't have the money to be able to bond him out if they do arrest him or he turns himself in, is there any legal thing I can do to get the warrant dropped without all of that? I'm willing to pay for my sins, and again he shouldn't have to.

Try speaking to the DA, They have the right to continue to pursue the case on their own (even if you don't want them to) but if they feel this was a one-time incident and will never happen again--they may drop it. They want to make sure no abuse is continuing if and when you two are back together.


World Law's lawyers could also probably intervene and help resolve this if need be. You may email them on the home page.
