Parole Period Exceeds Maximum Allowed
Dear Sirs or Madames:
My brother was just arrested and charged with a crime he did not commit. His trial starts in December. However, he is unable to get bailed or OR'd due to a "Parole Hold". The Parole Board has stated that he is in violation of his Parole due to his arrest and will be returned to prison. However, our records and facts indicate that he has been on parole for more than the 3 years. The maximum allowed by law. He reached the limit (with no rules violations or citations) last December 2007. Repeated requests to his PO for review and release went ignorred by the DOC. Technically he should not even be on parole anymore. Yet, the system has railroaded him back to serve an additional 1 year term. Is this legal or some kind of violation of his Constitutional Rights? Please answer this if you can. We live in California and I referenced the California Penal Code - Section 3000 for my information. Can you please confirm? Thanks |

A criminal law lawyer can petition the board with the evidence of the expiration
if you are correct they will have to act. They often do err. |
