I have an opportunity to work for a life insurance company in California.I am required to get my license and have a D.O.J. background check.i went to D.O.J. and requested a background scan as I was arrested in my younger years, most recently about 17 years ago,its obvious to me that these arrests will prohibit me from passing the background check,no felonies, but some misdemeanor convictions for assault and petty theft. Can these types of offenses be expunged and or sealed? If so are they completely erased so they cannot be used against me?Signed,Regretful Man.

They often can be yes.
Check with a local crimnal law lawyer for assistance and/or call the clerk of the court that was involved to get info. |

I have talked to a epungement specific lawyer, and these items can be expunged,is there a way to know the criteria for the background investigators as to whether they will allow licensure in a specific case? Thanks.

You can call the licensing Board and get a list of items that may need Board review or that prohibit a license.

I would suggest you directly call them. That is what they are there for--to provide just that kind of information.

How does one contact the Courts to obtain the official records of these misdemeanors in California? Two were 30 years ago and the most recent was about 17 years ago.Thanks.

The local DA should be able to direct you.

Thanks for the reply.I talked with the records division of the Superior Court in my jurisdiction and was told they dont have any records on misdemeanor court cases pre 1990.I was told to submit a form, which I did, that requested all info on myself pre 1990 and that i would receive a letter stating that pursuant to a law that there in essence is no paper trail or etrail of my convictions.I assume that expungement becomes uneccessary in this case,or am i wrong? Thanks.
