A friend of mine was arrested for posession and sale of cocaine. I
think this is a class B drug offense in New York State. However, he did not physically have the item and witness expressed to the officers that it was not his. The officers do not have any evidence besides the fact that he was in close proximity of the substance. What can he do? |

He should hire legal counsel to help develop that very argument.
Presented correctly it may be enough to get a dismissal. |
