im currently on probation in ks and want to get off asap before this can happen i have fines and restitution to pay this is no problem for me, but the other person involved in my case has been complaining and now apparently has to be at all of my court dates i was gonna find out what my restituion was before this year but it keeps gettin pushed back and now its right next to my scheduled release date. can they do this? or what can i do to make him not allowed at my legal perceadings. on a side not some one told me about speedy trial laws and mention something that they cant keep setting stuff of for 6 mos not sure if thats true someone help please!!!

I wish to inform you that generally the amount of restitution is awarded in a supplemental judgment. Further, the supplemental judgment is passed within 90 days of the main judgment. However, the court may at its discretion grant additional time to award the supplemental judgment. In some states, the victims have a right to attend those hearings where the defendant is present. Further, there is a right to speedy trial which essentially involves limitation of continuances. You may move a Motion for Speedy Trial.

If you're on probation for this same offense that you need to pay restitution for then speedy trial laws don't apply because you've already been sentenced. If part of your probation means paying the fine and the fine hasn't been set then what is the big deal? You're just getting longer to save up money before paying it. Being on probation shouldn't be a problem, if you need to meet with a PO maybe the visits will decrease.
