When I was 18, I was released from juvenile hall for driving a vehicle without owner’s consent. I ran into the wrong crowd, drove someone’s car without their permission. I obtained my GED while incarcerated, worked vigorously on my academics and maintained straight A's, was visited by the school administrator and maintained my goals on education. after my release I was still feeling the dramatic life changing effects of a sever car accident of which I was passenger to. Some say this was the reason for my rash actions at times. When I was 17 I recived a lengthy 12 hour corrective surgery in which the surgen damaged my lungs and an error occured. For the accident which had occurred 2 days after my 16th Birthday .Enough about that I was out on my own with my exgirlfriend who wrote me every day in juvenile hall. We needed clothes more than our freedom- now that I think about it. She was an open clepto, a foster child who was stolen from frequently by girls in foster care. We shop lifted at the wrong place apparently. SEARS, one of the highest convicting dept. stores in the nation. So we made some uneducated mistakes, that’s all I can call then from this point. It was charged as Grand theft, a charge that is a considered a wobbler. They called it grand theft because I used a pair of nail clippers I had on my keychain to clip a zip tie with a tag. My first experience in the legal system, the juvenile issue was very impersonal and completely different. I took a deal because I was scared with jail, and got probation which can be quite the bind. Live and ya' learn. Now I’m 20 trying to make sure nobody can control me..Well I’m saying I want my Rights! I'm looking at career paths. I want to make money so no one can say what I have to do with my life.
I'm living with my Dad who is a trucker, I have a car. Normal 20 year old life for the most part. My Dad was a strict evil bastard.
My dad wasn't home one day, and I had come back from a trip to Big Bear. I entered his house as I had done before by jumping over the fence and into the yard (knowing the dog), and climbing in through a window.
Unfortunately my meth using neighbor didn't like my dad’s truck on a cul-de-sac that wasn't too truck friendly. He didn't like the kids hanging around by his house. He was seen outside writing down peoples license plates, and the parking enforcement would arrive the next day or a police cruiser would pull up and scan a vehicle. They once thought my car was stolen and tried to have it towed because it was parked in front of my house and had a little damage we were working on. I took a laptop left and went down the street to my friend’s house, He wasn't home. I left the laptop at his house because I didn't want to carry it and went to our other friend’s house a few blocks away where he hangs out. His parents knew me and where pretty easy going. I hid it from his little cursing foul mouthed elementary-middle school aged little brothers (4)
Suddenly a police car speeds by. Then doubles back a few moments later. They stop me, they said, "Start talking". I figured I'd be released alot quicker if I told them what was going on.
They got the laptop, took me back in front of my house, and parked me in front of at least 7 cop cars which were admitted in court by a police officer at the scene. My father has just arrived, there’s hope at last.They told my dad that a perp had entered the house, and asked him if anything was missing, and didn't identify me as his son until they were done compiling statements and paperwork. This was testimony of my father in court.
My dad, with no experience with the legal system whatsoever besides speeding tickets contacts a Lieutenant who tells him the charge will not be filed. And I will be released Monday, it was a Friday
3 days pass, I’m still in jail. He calls back the charge is not dropt.
Then came the DA, my dad was frequently on the road and far away from home across the country struggling to barely make ends meet. He took a parked his truck and took a plane to LAX when he heard, and went to the DA’s office, the DA’s assistant told him they would drop the charge the next court date. That never happened
THE JUDGE
Now the case goes on and on and on and on I spent 8 months in the disgusting LA County Jail. During a time when the supreme court made an admission to stop lower courts from sending people to prison for property crimes due to the critical situation with prison overcrowding in California. Then was sentenced to a year in Prison
Grand Theft 300 Dollars isn't 300 dollars anymore.
From the year of when this law was created.
Laws like this need to be adapted to the CURRENT economy.
Before I could figure out how to successfully file a habeas corpus, or a coram vobis, or reasonably obtain a comfortable amount of knowledge on the extensive complicated legal matter. I was released.
Now I’m out Made off of parole. Some might call me a ninja. Several warrants were issued and recalled.. Eventually the head of the Parole dept used her Administrative discretion and let me off.I would like to go into the Army! wtf do I have to do? Can anybody help?
Or I would like find a sensible career, and ultimately both would be ideal. I wrote a 97 page screen play while I was in prison based on my life.
Any attorneys out there that would like to know more about the potential claims regarding the errors in the hospital
