Default shoplifting

my son was caught in shoplifting at the home depot, worth of under $30.
They
took his name and his home address, he had no ID with him at the time, so
they took his picture. Today the law firm which represents the home depot
want him to pay $350 or they will file a civil law suit plus attorneys fees.

What should we do? thank you

Pay it but ask for a release saying they will not take or report any further
action. It is commonly resolved that way.
