Default Can misdemeanors be expunged in Montana?

What types of criminal records, or convictions can be expunged in the State of Montana?

Can misdemeanors be expunged, or are you better off fighting them in the first place...I call local law enforcement practices of following kids around to hand out M.I.P (minor in possession-of alcohol) violations to the tune of $300 a pop \"Tax Collecting\"...because of this misdemeanor charge there have been 2 arrests with more charges (resisting arrest, obstructing a peace officer) which are also misdemeanors, but do go on the record if guilty. I need to know how aggressively to fight these charges, or not, if they can later be expunged.

What are the criteria for getting expungements done?

Hi--Montana does not allow expunctions or expungements in the same fashion as many states do...so it is best to fight the charges.

How would you be able to fight them? If they have the evidence of a PBT, do you need an attorney to make a bargain or is there absolutely no way you can win?

What states allow expungement? If states don't allow, why does the expungement terminology even exist?

Are there any Montana lawyers that would try to overturn a guilty plea to disorderly conduct from a 18 year old from 20 years ago. I agreed that I had kicked my bedroom door and mother asked judge to drop charges.

Check with your state bar for appellate and post-conviction lawyers.

It is a legal specialty and helps to have somebody that does primarily that kind of work.
