She can sue yes. Pictures intended for private consumption cannot be posted. He was not authorized to release that private picture.

It is even a crime in many jurisdictions.

The answers here are incorrect from a legal standpoint.

If the ex-girlfriend allowed this man to take nude pictures of her, the photos belong to him. He can do with them whatever he wants to.

Unless there was a contract that stipulated "private consumption", she's dead in the water.

You cannot post nude photos of another person online without their permission, even if you let that person see and have them privately.

The person can be sued, and often prosecuted.

Wrong. A person can. They might be sued by the person in the pictures, but they can post them. They don't need permission. Pictures are the property of the person(s) who took them.

If the person was photographed naked in a public place, like on a beach, you cannot be sued for posting the picture.

If the person gave you a disclaimer that you could use any pictures you took for publishing, then you can publish them on the Internet.

The problem comes where you take candid pictures of your bf/gf in a private place, like a bedroom. The question is - did that person have a reasonable expectation of privacy, and did they reasonably expect that the picture would not be made public? In that case, you could be sued, and it would be for a court to decide.

In general, producing or distributing sexually explicit images of people, whether they consent or not, is not against the law, except for cases involving children.

c. An actor commits a crime of the third degree if, knowing that he is not licensed or privileged to do so, he discloses any photograph, film, videotape, recording or any other reproduction of the image of another person whose intimate parts are exposed or who is engaged in an act of sexual penetration or sexual contact, unless that person has consented to such disclosure.

For purposes of this subsection, "disclose" means sell, manufacture, give, provide, lend, trade, mail, deliver, transfer, publish, distribute, circulate, disseminate, present, exhibit, advertise or offer. Notwithstanding the provisions of subsection b. of N.J.S.2C:43-3, a fine not to exceed $30,000 may be imposed for a violation of this subsection.
