Can my husband really be charged for esp.agg.robbery. He went with two other men. They went in to a house. The man got hurt by a bat..by one of the other guys. My husband stepped into the house and got into it with the owner and he cut his hand by them fightin over the knife... then he went outside. Later the other guy had his wallet and keys but had no part of them takin them and don't know wher he got them either..please someone help we have 3 kids and ther tryin to give him 37yrs. over this... he didn't have a fair trial..ther where lots of lies. Can they use ur past for a sentencing? No character witness?

They can charge him but they have to prove it--and his role. And that may not be easy to do.

You MUST have legal counsel at this point and frankly if at all possible get your own private lawyer that will have time to devote to the case.

His past is not generally supposed to be an issue in the current charges.

Thanks...They did charge him but they used what the other guys did too him...said it was cuz he was there too..I thought u could have in ur trial only what u do? his appointed lawyer she no and didn't help much that i fill!!!! No motions or appeal or nothin was done...They sentenced him the first time 45yrs.and used his past against him...Then i found out they did something wrong said it was because they used this past and brought him back wks. later to resentence him.....and used it again..gave him 37yrs.???? tryed and tryed and left many msg. to his app.lawyer he never returns my calls.. tryin to hire lawyer they want 10thousand or more...i'm tryin to find things that we can do ourself till i can find someone thanks again any help is better than none!!
