Confused Possible Statutory Rape?

This is in California. If that makes a difference at all.

My Son is 15 years old, and he is currently dating a 12 year old girl. She is turning 13 in September. My son turns 16 in March.

I know Statutory Rape is defined as having sex with someone below the age of consent.

We know it is illegal for them to have sex. (Not like I endorse it.)
They are not having any kind of sex, or had any kind of sex. They haven't even kissed yet because my son is also concerned about laws about Statutory law and getting himself and us into trouble.

Is it illegal for two young ones to be dating at this age?

Is it illegal for them to kiss at this age?(I ask this because my son's friend got kicked out of a mall for kissing a girl... just wondering)

Is this violating Statutory laws or any kind of laws?

Unfortunately, no. They are both minors.

I would question the morality and values of a parent who allows their 12 year old child to date, however. I would question the same who allows their 15 year old son to date a 12 year old child. While it may seem like a slight difference in age, children develop at different stages and a 15 year old boy is already in the throes of puberty while the 12 year old is still just a child interested in playing barbie dolls with her friends.

This is why unwed parenthood and teen pregnancy is at such epidemic levels.
