Hi,
I'm facing misdemeanor annoying/accosting charges after I yelled at a girl in my dormitory for putting tampons on my door. She claims that I called her names like "*****" and "twat" and made remarks about her being incestuous with her father. Because of the heated nature of our quarrel, she called the police after I left. She claims me or 1 of the 2 guys I was with threw a beer bottle down the hall and threatened her boyfriend...I did neither although the two acquaintances are not being charged with anything. The police are now pressing charges against me for this. The report is quite frightening for me as she explicitly claims I made her uncomfortable throughout the year and regularly approached her as well as the untrue statements she claimed I made that night. I have a clerk's hearing at the end of the month. My lawyer said he could probably clear things there but while he just send me the report, I'm not sure if he read it as it is very harsh in regards to the girl's statements. I did just graduate from the university and am over 200+ miles away while she is still attending the school there which might help my case. But like I said, I don't want to be registered as a sex offender or sent to prison as I know the worst case scenario would happen. Based on this information do you think there is a good chance I might be able to make a plea bargain and get things settled at the hearing??? I'm devastated here. |

Sorry for your situation. You definitely need to work very closely with your lawyer -- that is the most important thing here. While no guarantees can be made, if you have an otherwise clean record I would see room for negotiation here. Specifically, I could see a plea to a reduced charge of reckless conduct or harassment without need for sex offender registration. Hope it all works out for you. AJJ
