I was convicted of drug possession back in Sept. 2008. I initially turned down Prop 36 and took the 30 days in jail and 3 yrs. probation. At the time, that was the best decision for me to make. I have since violated my probation because of 3 dirty tests in over 2 months, and the DA told me in court on May 8th that I was going to be remanded into custody unless I agreed to do Prop 36. I agreed and the judge ordered it. I went to the Prop 36 orientation and thought everything was fine. Apparantly not, because, the Prop 36 lady called me and told me I had to go back to court because I wasn't going to get Prop 36. I went back to court and the judge took it away from me. I have another court date this coming Monday to find out what they're going to do with me. How can they take it away form me once the judge has ordered it? My Probation Officer told me she wasn't going to release my case and I'm pretty sure she is the reason this is happening. What can I do?

[Apparantly not, because, the Prop 36 lady called me and told me I had to go back to court because I wasn't going to get Prop 36]
Can you call her and ask the reason? That would be a good first step. Get your lawyer involved as well--asap. |
