Unhappy In Florida I got a DUI and I was not driving at the time

On Saturday morning I left my house and at the end of the road went through a yield sign into a retention ditch. I couldn't back out of the ditch and a bunch of guys came out from accross the street and started yelling at me and heckling me. I got rattled and put the truck in drive and I drove forward out of the ditch and turned around and went back home. I was home for approximately and hour when I had a few cocktails. About an hour and a half later there was a knock on the door, it was the Orange County Sheriff's Department. He said the people at the end of the street called and said I hit the ditch and it looked like I had been drinking. I never got out of the truck or spoke to anyone so I don't know why they would think I had been drinking. I WAS NOT DRINKING when I drove the truck. I did not drink until after I got back home. I was extremely rattled and upset. The police officer was being mean to me and I got very angry at him, granted, but I kept telling him I was not drinking an hour and a half earlier when I hit the ditch. He wanted me to take a breathlyzer and I refused. I told him to feel the engine of the truck, it is cold, I may be drinking now but I was not drinking an hour an a half earlier when I was in the truck. After my refusal to blow, he arrested me for DUI and took me to jail. They kept me there for 28 hours.

I am unemployed, and will not be able to pay my rent this month. I have been looking for a job in Orlando for a year. Since I will not have anywhere to live when I get evicted for not paying the rent, I have to go back to my home state of NY where I will have a place to live. I was planning on leaving the first week of May but now have to wait for my court date on May 13.

What do you think are my chances of getting the charges dismissed? If I can't get them dismissed, will I be able to get a hardship license to move back to NY and have probation and whatever I have to do be transfered up there? I have no income, no money, and am completey indigent at this point. I have $300 to my name and I need that for gas to get to NY. I will have to leave everything I own, couches, bed, furniture, etc and grab my clothes and get out of here.

Please someone help me with this and give me some advice. If I can't get this dismissed and get to NY I will be not only unemployed but homeless as well, and won't be able to pay any fees or anything. What do I do?

The public defender said they won't see my file until at least the end of the week and I am going insane with worry. Someone please help me.
