When I last called DEA three months ago salvia was not banned on the federal level.

Not sure if each state is taking differing approaches but you can call your local police or DA and they can easily confirm for you.

It's legal in Texas, I smoked it last weekend, but you have to be atleast 18 to buy it. You can get it anywhere that sells pipes and whatnot.

There are two bills right now:

one to make it illegal to distribute to a minor or to another who intends to do so

the other to make it illegal to grow or possess in any form, plant, leaves, extract, seeds, salvinorum chemical, anything. I believe the latter takes effect on September 1, 2009, but I could be wrong
