small retail theft by a minor

If retail theft of less than $50.00 was attempted by a minor but they were caught before leaving the store can a lawyer sue them without the permission of the retail stores permission?

Ok you give little to work with here. Had the minor passed last point of sale? What state was this in? Many states say concealment alone is a crime. I know someone in this area of law. Contact me through this site and I will put you in contact with this person

It could be that the store, knowing that there's nothing much for them to gain in prosecuting a case like this has their real attorney just try and "scare kids straight."
