Default Battery

I was just wondering if I can sue this girl I got in a fight with (I am female as well). She was sitting beside me at my high school (we are both 18) and I was pointing to something. My arm was in her way and I didn't realise. This made her angry and she spoke to me in a rude manner. I told her there was no need for her to speak to me like that and she could leave if she wanted. She got even more angry and started pouring juice on me. I got up and knocked the juice out of her hand and told her not to throw juice on me. She began to fight me but I didn't swing any punches. She grabbed my hair and pushed me over and thre me to the floor. She ripped out one of my earings and my ear lobe ripped in half. I had to get 6 stitches and the doctor said that the skin would heal but the cartiledge inside would never heal. I got suspended from school for 3 days but she got suspended for 10. Can I sue for any amount of money? If so, how much? Is it even worth taking her to court?

Her first attack by pouring juice on you is illegal. You can file a police report.

You could try to sue but would have to show what damages you have.

Can you sue? Sure can. The court however will determine who the aggressor was, and most likely if it was the other girl then she will be found at fault. If the injury occurred in a warranted act of self defense, then it may be hard for the court to rule against her. Although this may not have been this girls exact means of hurting you the way she did.

What you need to prove this is witnesses. He said, she said wont work unless she admits wrong doing in court herself.
