Does a 72 hour hold in the facility constitute committed?
Utah
What is the proper definition "Anyone who has been adjudicated as a mental defective or has been committed to a mental institution."? Does a 72 hour hold in the facility constitute committed? Ok, my mother signed paperwork to have me evaluated in a mental institution because she thought I was suicidal that was on a Friday afternoon held over the weekend; on Monday morning I spoke with the psychiatrist and minutes later was release. I dont recall all of the details but I was not ordered to go and get further treatment. This incident happened 13 years ago, I went to a local gun store and tried to purchase a gun and was denied. Apparently my name and social security number was on the NICS system, supposedly that I was mentally ill, but this information was entered and reported by a different State from where the incident happened. The name that came up with a middle name which I dont have, and I have had issues with this name in California before in the past. |

Those holds do apply at least as to reporting, but if need be get legal counsel and they can help you resolve that.

The 72 hour hold facility is just that. Its been deemed a holding facility up to 72 hours based of its size and facility conditions. Most small, and some large departments have a 72hour holding facility which can be used to hold anyone up to 3 days. Does not mean its for suspected mental people, although they may use it to detain you until they got you the right help if they so thought. Last edited by tswift : Oct 12th, 2008 at 11:21 PM. |

Re: Does a 72 hour hold in the facility constitute committed?
Is it a disqualifier for gun purchase according to Federal Law?
I think it might be a mistake identity or this individual is using my social security number. I would think that if this reporting is because of the 13 years old incident, it should have been reported by my home state. Not a state that I have never been too. I have been ask to fill out a VAF and submitted to the FBI for research. Is this possible that a different state report something like this from a state? |
