Hello, I have been married two months and have been moving into my place for the past two weeks or so. My wife who is 23 and mexican(if any of this matters)
has a daughter. Her father is accusing me of molestation of some sort because she said when I carried her I scratched her tortuga(Genitals) and Pompa(butt). I have never been alone with her, and the 3 times I picked her up from school I brought a friend. My wife said these accusations have happened twice in the past always with a boyfriend in her life but doctors said all was well. The child is four years old. A social worker has contacted my wife and is expected to meet with her Tuesday.I am worried about her and her daughters welfare as well as my own. What should I do to protect myself. I am no longer staying at our new apartment. I am at my old place so she can be with her daughter? Should I contact the social worker.Can I be arrested for this as it stands? Should I have an attorney present if I talk with the social worker. Should I make a list of friends??? Sounds like dad or somebody has some problem. Avoid any situation where you might be accused. It should all die out but if not yes get a lawyer involved. Last edited by wld_team : 08-30-2008 at 06:16 PM. |

Thank you for your response. When this first came up I suggested to my wife to see a social worker and I told her to bring her to the doctor today if thats any help. But the father is directly accusing me through the social worker. I have never met this man.

I bet that situations like are fairly common and the vast majority of these cases never get beyond first base.
I've found that it is often possible to get ten or fifteen munutes of free legal advice by simply calling a law office and asking to talk to a lawyer about the situation. Even on a weekend, it might be possible to find a lawyer who is in his office, or can answer from his home. |

OK So my wifes daughter talked to a social worker, and then later my wife did. To keep it brief they said to her she could have me back home if she wanted and they would talk to me Wed.. Well today, Friday, a woman called and set up an appt. with me for 9:30 Monday.. I spoke with a Criminal Law attorney briefly and he said to NOT talk with them. He said they are probably looking to close the case but there is no reason I should go in and incriminate myself somehow. I said that I have nothing to hide, which is the truth, and what happens if it stays open. To this he said "So What." They stop by every now and then and thats about it. Somehow to me this feels wrong. I don't feel my wife her daughter or myself should be monitored or watched. I feel if I back down and don't go in I am not standing up and doing the right thing. Instead I have let a manipulative and scary influence (her father) control our lives with no regard to the welfare of not only his daughter but his granddaughter. I WANT TO DO THE RIGHT THING, MY HEART SAYS STAND AND MY HEAD SAYS RUN. If I do go should I bring an attorney? Do I really have something to be scared of? If social workers are like the police as the attorney said isn't it better to be as cooperative as possible?
