Confused Help for a possible assault/battery on a minor

My 16 year old neice was beaten up by 3 older women. Witnesses stated they were kicking her in the face. These women are all over 18, and I know that one is over 30. What charges can be pressed against these individiuals?
The police are telling her father that they do not consider her a minor? We
did take her to the ER and had everything documented. Any direction would
be appreciated. I do not feel the police in our area may be charging to the
maximum in this case.

wow. i can't believe they said she's NOT a minor. when it comes to assault & battery, some states do not consider 15 & older minors. there are many issues that go into this. go to the witnesses & get their signed statements. get them notorized if possible. also-GO to the police station and REFUSE to leave until they give you the warrant copy for the attacker's arrest.

IF they threw the 1st punch, it IS assault and battery, but if she "defended" herself (this is a load of crap) against just 1-it's mutual combat. BUT if you're SURE there were 3 of them that jumped her they will be charged w/ ganging. Which means a greater charge & more jail time. LOTS more.

Either way, you can always take them to civil court, even if they're charged criminally. If not, I'm sure the judge in civil court may help w/ that. It depends on how fast you move and how much you get done criminally first. You do need to bug the crap out of the police until you get some results. Make sure she didn't instigate the fight also. If she did, there will be complications in charging the group. They will give you issues about filing charges anyways bc appearantly cops are pretty lazy. This is only the experience I've had lately. Good luck & make sure you document everything. You did great by going to the hospital, sometimes fights can give injuries that you wouldn't even think of; internal bleeding included.
