How to settle with the alleged victim?
Can I settle with the alleged victim and avoid crime charges? The facts of the case are very unclear.

The state can still proceed even if the victim does not want to proceed and even if all involved settle. And usually they will once charges have been filed. But the more unclear the facts are etc. the more likely the DA will not proceed if the parties have reached some agreement. (If it is he said /she said the court simply has to try to look at all the evidence.) Or the charges can be substantially lowered even to non-criminal law status. It often becomes too difficult and a waste of time for the DA to proceed. So it may be worth seeing if a settlement can occur. It is best to have a lawyer handle as you don't want to appear to be affecting/challenging witnesses etc.
You do not want this on your record so best to do whatever is suggested to make that happen, and have a lawyer handle this if possible to keep it off the record. It is worth the money. |
