Hi,
My Husband is currently in custody because he is being accused of kidnapping and assault with a deadly weapon not a firearm. The Victim which is an older man claims that my husband and two other guys came to his house in a maroon expedition at 6:30 in the morning and made him get in the car, took him to different places and then took him home. Since the D.A. decided to pick up the case, she wants to sentence my Husband to sixteen years in prison. The D.A. has no evidence and the other three people that are also being accused in this case say that they do not even know my Husband. My Husband does not have a car or a drivers license and we do not know anyone with a maroon expedition. Plus we had went to a football game that morning around nine my Husband was the last one to wake up. My Mother in law, Father in law live in our home and we all are available to testify to this. Also there were other people that day at the game that will also testify to him being there. Since then our attorney indicated that he went to go speak to the victim and he clearly was on drugs and did not want to cooperate with him. Also when they went back a second time he was missing. My question is can they convict my husband without any evidence other than a non credible victim. They do not have a car, pictures of this victim beat up, nothing. |

There should be some surveillance records at the game etc. that may show where he was--or other such evidence.
--get a private detective involved if need be! |

We do have pictures of us at the game, and the team that was playing against our nephew is in the backround. We also have a schedule from the game to show the teams that were playing that day. However, this so called victim is saying the the crime happened at 6:30 am and the game did not start till 9:00 a.m.

Gather up whatever else you can to show where he was.
But why is the victim ID'ing him? |

Our Attorney, had an investigator go out and try and speak with the victim and he said that it was evadent that the victim was under the influence of drugs. Also the other three co defendents are all saying they do not now who my husband is, my husbad says the same about them?
