I have been accused of a crime, the only case the DA has is my
"confession" or the statements I made to the cops while in my parking lot. My question is, what is the legal def. of being in custody. They never read me my maranda rights. I kept telling them I did not do it, they kept saying I did and they had all this proof and stuff, and people were starting to look outside and the complex security guard came around and people were coming back from the bars, they were questioning me in the parking lot, so I finally told them what they wanted to hear. And what I told them is totally different then what the \"victim\" told them. I have been told they did not have to read me my rights since I was not in custody. I also did not ask to leave or for a lawyer. I would like to know what the def. of custody is, and when Miranda should have been given. Thanks for your help. |

You were in custody at that point if you could not leave.
...make sure you have a lawyer review the details and advise you as a next step. Don't try to handle this alone. |
